All rights not expressly granted to you in these Terms are reserved by SH Mart LLC.

4. Payments and Renewals

Fees and Billing

Some Services require payment of fees. You agree to pay all applicable fees as described in the Services when you place your order.

Automatic Renewal

Unless you cancel your subscription before the end of the applicable subscription period, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee using any payment method we have on record for you.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.

Refund Policy

We offer a 60-day money-back guarantee for most products. If you are not satisfied with our Services, you may request a refund within 60 days of your initial purchase.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SH Mart LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SH Mart LLC OR THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SH Mart LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL SH Mart LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID SH Mart LLC IN THE PAST SIX MONTHS, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless SH Mart LLC and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Dispute Resolution

Informal Resolution

Before filing a claim against SH Mart LLC, you agree to try to resolve the dispute informally by contacting us at legal@nortonsecurity.com. We'll try to resolve the dispute informally by contacting you via email.

Arbitration Agreement

Most disputes can be resolved without resorting to arbitration. If we cannot resolve a dispute informally, you and SH Mart LLC agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth below.

Exceptions

Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement without first engaging in arbitration.

NO CLASS ACTIONS

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

12. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of the Terms and, in some cases, we may provide additional notice (such as adding a statement to our website or sending you a notification).

By continuing to access or use the Services after the revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
